Here below, we've outlined a brief overview of the application process for an H1B Visa.
- Employer files a petition on behalf of the prospective employee. The application needs to be job specific and needs to mention the exact duties of the position, the dates of employment and other related information.
- The actual wage being paid is compared with the 'prevailing wage'. The employer is required to pay the higher of the two.
- File the Labor Certification Application (LCA) - in which the employer gives information about the company and agrees to certain conditions mentioned therein.
- Upon approval of LCA, the Department of Labor will send a certified copy to the employer.
- The employer must then post notices of the H1B filing in two places at their business for a period of 10 days.
- Petition is then filed with the appropriate BCIS Service Office.
- Upon approval of the petition, the H1B beneficiary then applies for personal and family visas at the Consulate
The entire process can take a few months. If the employer requires faster processing, then they have the option of going in for the Premium Processing Service, where an extra fee is charged for faster processing of the petition.
